Supplemental Truth Social Terms of Service for U.S. Federal Government Agency Official Use

If you are an official of a U.S. federal government agency (“Agency”), and you are using Truth Social (the “Service”) in your official capacity for official government purposes (“Official Use”), the following modifications of the Truth Social Terms of Service apply solely to such use.

1. Federal Law: The Truth Social Terms of Service and Agency’s Official Use of the Service shall be governed by and construed in accordance with federal law, without regard to its conflict of law principles.

2. Indemnity: Provisions of the Terms of Service relating to indemnification do not apply to Agency Official Use except to the extent expressly authorized by federal law.

3. Non-Endorsement and Modification of Contributions: The Service agrees that Agency seals, trademarks, logos, service marks, trade names, as well as the fact that Agency has an account and uses the Service, shall not be used by the Service in such a manner as to state or imply that the Service or any products/services related thereto, are endorsed, sponsored or recommended by Agency. The Service further agrees that it shall not substantively modify Agency Contributions.

4. Disclaimer Requirement: If Agency has an official website, Truth Social profile(s) reflecting Agency Official Use must contain a link to such official website.

5. Dispute Resolution and Jurisdiction: Agency Official Use shall not constitute consent to any jurisdiction, forum, venue, or form of dispute resolution (including, without limitation, binding arbitration), or waiver of any defenses thereto. Insofar as it relates to multi-party actions or lawsuits, Paragraph 23 of the Terms of Service does not apply to Agency Official Use.
